A v nemeckom pracovnom pr\u00e1ve m\u00e1 ve\u013ek\u00fd v\u00fdznam. <\/span><span style=\"font-weight: 400;\">Rozli\u0161ovanie medzi t\u00fdmito dvoma typmi pracovn\u00fdch zml\u00fav prispieva k vytvoreniu kooperat\u00edvneho a pr\u00e1vne bezpe\u010dn\u00e9ho pracovn\u00e9ho prostredia. Je to d\u00f4le\u017eit\u00e1 pom\u00f4cka na zabezpe\u010denie s\u00faladu s pr\u00e1vnym r\u00e1mcom v Nemecku.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Pre zamestn\u00e1vate\u013eov je v\u00fdber spr\u00e1vneho zmluvn\u00e9ho pl\u00e1nu rozhoduj\u00faci pre riadenie t\u00edmov.  Z\u00e1rove\u0148 zabezpe\u010duje pr\u00e1vny s\u00falad.  Na druhej strane, pre zamestnancov porozumie\u0165 zmluve znamen\u00e1 pozna\u0165 svoje pr\u00e1va a povinnosti. Druh\u00e1 strana (\"objedn\u00e1vate\u013e\") je povinn\u00e1 za t\u00fato slu\u017ebu zaplati\u0165. <\/span><span style=\"font-weight: 400;\">Pri tomto type zmluvy sa d\u00f4raz kladie na v\u00fdsledok pr\u00e1ce a nie na kontrolu poskytovate\u013ea pr\u00e1ce\/slu\u017eby. \u010cas str\u00e1ven\u00fd vykon\u00e1van\u00edm pr\u00e1ce tu nie je d\u00f4le\u017eit\u00fd. Nie je d\u00f4le\u017eit\u00fd ani sp\u00f4sob jej vykonania. D\u00f4le\u017eit\u00e9 je, aby sa pr\u00e1ca alebo slu\u017eba \u00faspe\u0161ne vykonala.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Spolo\u010dnos\u0165, ktor\u00e1 z\u00e1kazku realizuje, je samostatne z\u00e1robkovo \u010dinn\u00e1. Je v\u00fdlu\u010dne zodpovedn\u00e1 za svoje vlastn\u00e9 dane a odvody. A nepova\u017euje sa za priameho zamestnanca klienta. <\/span><span style=\"font-weight: 400;\">Pracovn\u00e1 zmluva pon\u00faka ve\u013ek\u00fa flexibilitu a je orientovan\u00e1 na v\u00fdsledky.<\/span><\/p>\r\n<p><a href=\"https:\/\/personal-polen.de\/sk\/pracovne-zmluvy\/\">V\u0161etko o pracovn\u00fdch zmluv\u00e1ch s kvalifikovan\u00fdmi pracovn\u00edkmi z v\u00fdchodnej Eur\u00f3py &gt;&gt;&gt;<\/a><\/p>\r\n<h2><span style=\"font-weight: 400;\">\u010co je to do\u010dasn\u00e9 zamestnanie?<\/span><\/h2>\r\n<p class=\"translation-block\"><span style=\"font-weight: 400\"><a href=\"https:\/\/www.arbeitsagentur.de\/unternehmen\/personalfragen\/pflichten-arbeitgeber\/arbeitunternehmenueberstellung\" target=\"_self\">Pren\u00e1jom zamestnancov<\/a> je osobitn\u00e1 forma pracovnej zmluvy.  Vyu\u017e\u00edva sa pri do\u010dasnom pracovnom pomere alebo person\u00e1lnom l\u00edzingu.  <\/span><span style=\"font-weight: 400\">\u00dalohu z\u00e1konn\u00e9ho zamestn\u00e1vate\u013ea preber\u00e1 person\u00e1lna agent\u00fara.  Poskytuje a prenaj\u00edma pracovn\u00edkov, ktor\u00fdch prenaj\u00edma z\u00e1kazn\u00edckej spolo\u010dnosti.  D\u013a\u017eka trvania tohto druhu zamestnania je stanoven\u00e1 vopred.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">V s\u00favislosti s do\u010dasn\u00fdm zamestn\u00e1van\u00edm zamestnancov ide spravidla o tri strany:<\/span><\/p>\r\n<ul>\r\n<li><span style=\"font-weight: 400;\"><a href=\"https:\/\/personal-polen.de\/sk\/docasna-pracovna-sila-z-polska-a-vychodnej-europy\/\"><strong>Zamestnanci (do\u010dasn\u00ed pracovn\u00edci)<\/strong> <\/a>- Osoba, ktor\u00e1 je zamestnan\u00e1 u poskytovate\u013ea person\u00e1lnych slu\u017eieb. S\u00fa zamestnan\u00ed na plnenie \u00faloh pre klientsk\u00fa spolo\u010dnos\u0165.<\/span><\/li>\r\n<li><strong>Zamestn\u00e1vate\u013e (n\u00e1borov\u00e1 agent\u00fara)<\/strong> - Pr\u00e1vny zamestn\u00e1vate\u013e prenajat\u00e9ho zamestnanca. Person\u00e1lna agent\u00fara je zodpovedn\u00e1 za v\u0161etky administrat\u00edvne \u00falohy t\u00fdkaj\u00face sa zamestnanca. Patria sem dane, mzdov\u00e9 \u00fa\u010dtovn\u00edctvo, odvody at\u010f. Agent\u00fara m\u00e1 zmluvn\u00fd vz\u0165ah so zamestnancom aj s klientskou spolo\u010dnos\u0165ou.<\/li>\r\n<li><strong>Z\u00e1kazn\u00edcka spolo\u010dnos\u0165<\/strong> - Organiz\u00e1cia, pre ktor\u00fa do\u010dasn\u00fd pracovn\u00edk vykon\u00e1va obchodn\u00e9 \u00falohy. T\u00e1to spolo\u010dnos\u0165 potrebuje dodato\u010dn\u00fa pracovn\u00fa silu na obmedzen\u00fd \u010das. Je to spolo\u010dnos\u0165, ktor\u00e1 h\u013ead\u00e1 dodato\u010dn\u00fa pracovn\u00fa silu na dobu ur\u010dit\u00fa. Potrebn\u00fa pracovn\u00fa silu preto z\u00edskava prostredn\u00edctvom person\u00e1lnej agent\u00fary. Aby mohla vyu\u017e\u00edva\u0165 slu\u017eby person\u00e1lnej agent\u00fary, uzatv\u00e1ra s \u0148ou tak\u00fato zmluvu. Klientsk\u00e1 spolo\u010dnos\u0165 dohliada na pr\u00e1cu zamestnanca. Zamestnanec je v\u0161ak zamestnan\u00fd person\u00e1lnou agent\u00farou, a nie spolo\u010dnos\u0165ou, v ktorej vykon\u00e1va svoju pr\u00e1cu.<\/li>\r\n<\/ul>\r\n<p><a href=\"https:\/\/personal-polen.de\/sk\/pracovny-lizing-z-polska\/\">Viac o brig\u00e1dnickej pr\u00e1ci &gt;&gt;&gt;<\/a><\/p>\r\n<h3>Je pracovn\u00e1 zmluva na dobu ur\u010dit\u00fa pracovnou zmluvou?<\/h3>\r\n<p>Hoci pracovn\u00e1 zmluva na dobu ur\u010dit\u00fa (zn\u00e1ma aj ako pracovn\u00e1 zmluva na dobu ur\u010dit\u00fa alebo pracovn\u00e1 zmluva na dobu ur\u010dit\u00fa) je formou zamestnania, z\u00e1sadne sa l\u00ed\u0161i od klasickej pracovnej zmluvy.<\/p>\r\n<p>Pracovn\u00e1 zmluva sa zvy\u010dajne uzatv\u00e1ra medzi zamestn\u00e1vate\u013eom a zamestnancom a upravuje podmienky priameho zamestn\u00e1vania.  Zamestnanec je u zamestn\u00e1vate\u013ea v trvalom pracovnom pomere a svoju pr\u00e1cu vykon\u00e1va priamo pre neho.<\/p>\r\n<p>Na druhej strane zmluva o pren\u00e1jme zamestnancov sa uzatv\u00e1ra medzi verite\u013eom (\u010dasto spolo\u010dnos\u0165ou poskytuj\u00facou person\u00e1lne slu\u017eby) a n\u00e1jomcom (spolo\u010dnos\u0165ou, ktor\u00e1 potrebuje do\u010dasn\u00e9ho zamestnanca). Po\u017ei\u010diavate\u013e si zamestnanca najme a prenech\u00e1 ho n\u00e1jomcovi, ktor\u00fd vyu\u017e\u00edva jeho pracovn\u00fd v\u00fdkon. Zamestnanec je teda zamestnan\u00fd u po\u017ei\u010diavate\u013ea, nie u n\u00e1jomcu, a vykon\u00e1va pr\u00e1cu pre n\u00e1jomcu.<\/p>\r\n<p>Zatia\u013e \u010do pracovn\u00e1 zmluva \u010dasto zabezpe\u010duje trval\u00fd alebo dlhodob\u00fd pracovn\u00fd pomer, do\u010dasn\u00e1 pracovn\u00e1 zmluva je zvy\u010dajne \u010dasovo obmedzen\u00e1 a sl\u00fa\u017ei na vykrytie do\u010dasn\u00fdch prek\u00e1\u017eok alebo na podporu konkr\u00e9tnych projektov.<\/p>\r\n<h3>\u010co je potrebn\u00e9 vzia\u0165 do \u00favahy pri prij\u00edman\u00ed zamestnancov?<\/h3>\r\n<p>Pokia\u013e ide o do\u010dasn\u00e9 zamestn\u00e1vanie, existuj\u00fa r\u00f4zne pr\u00e1vne a praktick\u00e9 aspekty, ktor\u00e9 s\u00fa d\u00f4le\u017eit\u00e9 pre zamestnancov aj zamestn\u00e1vate\u013eov.  Tu je nieko\u013eko bodov, ktor\u00e9 je potrebn\u00e9 zv\u00e1\u017ei\u0165 pri naj\u00edman\u00ed zamestnancov:<\/p>\r\n<ol>\r\n<li><strong>Pracovn\u00e9 zmluvy a dohody<\/strong>: verite\u013e (spolo\u010dnos\u0165 person\u00e1lnych slu\u017eieb) aj n\u00e1jomca (spolo\u010dnos\u0165, ktor\u00e1 potrebuje do\u010dasn\u00e9ho zamestnanca) musia so zamestnancom uzavrie\u0165 jasn\u00e9 a pr\u00e1vne platn\u00e9 pracovn\u00e9 zmluvy. Ovplyv\u0148uje to okrem in\u00e9ho plat, pracovn\u00fd \u010das, n\u00e1rok na dovolenku a \u010fal\u0161ie soci\u00e1lne d\u00e1vky.<\/li>\r\n<li><strong>Jasn\u00e1 komunik\u00e1cia<\/strong>: transparentn\u00e1 komunik\u00e1cia medzi verite\u013eom, n\u00e1jomcom a brig\u00e1dnikom je k\u013e\u00fa\u010dov\u00e1.  V\u0161etky strany by mali jasne ch\u00e1pa\u0165 o\u010dak\u00e1vania, zodpovednosti a pracovn\u00e9 po\u017eiadavky.<\/li>\r\n<li><strong>Bezpe\u010dnos\u0165 a ochrana zdravia pri pr\u00e1ci<\/strong>: n\u00e1jomca je zodpovedn\u00fd za dodr\u017eiavanie zdravotn\u00fdch a bezpe\u010dnostn\u00fdch predpisov na pracovisku, vr\u00e1tane zabezpe\u010denia toho, aby do\u010dasn\u00ed pracovn\u00edci dostali vhodn\u00e9 \u0161kolenie a bezpe\u010dnostn\u00e9 vybavenie.<\/li>\r\n<li><strong>Monitorovanie a kontrola<\/strong>: verite\u013e a n\u00e1jomca by mali spolo\u010dne monitorova\u0165 pracovn\u00fd v\u00fdkon a spokojnos\u0165 do\u010dasn\u00e9ho pracovn\u00edka.
