Temporary employment in the construction industry - what is there to consider?

According to § 1b of the German Temporary Employment Act (AÜG), the assignment of workers by traditional temp agencies to core construction work is strictly prohibited. § 1b AÜG (hiring out of workers) is strictly prohibited.

Temporary work in the construction industry is only permitted if it takes place exclusively between companies within the construction trade . Furthermore, temporary employment under the AÜG is only allowed within five specific construction sectors: construction, roofing, demolitionscaffolding , gardening and landscaping. This means, for example, that only a scaffolding company may lend workers to another scaffolding company.

Temporary work in the construction industry faces numerous challenges, as temporary employment in the construction industry is only legally permitted under very strict conditions - in particular, because both the host company and the provider must be companies operating within the same construction sector.

Equal treatment principle

The principle of equal treatment in the construction industry can be deviated from in accordance with section 8 (2) AÜG by applying a collective agreement for temporary work - but only for a period of up to nine months. This allows the temporary employment agency to deploy staff flexibly and at short notice. In the construction industry, labour leasing must be carried out exclusively on an equal treatment basis. This means that the temporary employment agency must provide its employees with the same working conditions for the entire duration of the assignment.
